Terms of Service and Membership Agreement

1. Parties and Scope

This Terms of Service and Membership Agreement ("Agreement") is entered into between DijiFor Yazılım Danışmanlık Ltd. Şti., operator of the CalenFox platform ("Platform", "Service"), and the individual or legal entity registering on the platform ("User", "You").

The Platform is an online appointment management service where individuals can create their own booking profiles and third parties can submit appointment requests to those profiles.

2. Platform Access and Account

2.1 Registration Requirements

• You must be 18 years of age or older to register on the Platform.
• A natural person registering on behalf of a legal entity declares that they have the authority to represent and bind that legal entity.
• You must ensure that the information provided during registration is accurate, current and complete. Providing false information is grounds for termination of your account.

2.2 Account Security

• You are solely responsible for the confidentiality of your account credentials (email, password).
• All actions taken on your account are deemed to be yours.
• If you detect unauthorized use of your account, you must immediately notify info@calenfox.com.

2.3 Single Account

One person may only have one active account. Opening a new account for a blocked or terminated account is prohibited.

3. Acceptable Use

The Platform may only be used for legitimate professional or commercial appointment management purposes. Examples of acceptable use:

• Consulting, coaching and mentoring sessions
• Patient appointment management for healthcare professionals
• Legal, financial or technical advisory appointments
• Client meetings for freelancers and creative professionals
• Education, courses or private tutoring sessions
• Corporate meetings and job interviews

4. Strictly Prohibited Uses

4.1 Illegal Activities

• Creating appointments to facilitate the supply of narcotics or psychotropic substances
• Creating profiles for prostitution or any sexually-related services
• Trading in weapons, explosives or controlled substances
• Fraudulent, counterfeit or identity theft purposes
• Money laundering or terrorist financing
• Any activity contrary to applicable national or international law

4.2 Platform Violations

• Creating an account by impersonating another person
• Using bots, scrapers or automated request tools that could harm the Platform
• Harassing, threatening or discriminating against other users
• Sending spam or unsolicited commercial communications
• Uploading malware or probing for security vulnerabilities

5. Content Responsibility

You are solely responsible for the accuracy and legality of all information, text, photos and content published on your profile. The Platform does not pre-screen user-generated content.

Uploading content that infringes the intellectual property rights, personality rights or privacy of others is prohibited.

6. Profile Page and Public Visibility

When you activate your profile, the information you designate (name, title, biography, working hours) becomes accessible via a publicly available URL. You acknowledge that you are acting with awareness of this.

You may hide your profile or delete your account at any time.

7. Visitor Obligations

Visitors requesting appointments through a user's profile page:

• Must request appointments using their real identity and contact information.
• Must only submit appointment requests for genuine meeting purposes.
• Must refrain from misusing the system, sending spam or creating fake appointments.

8. Suspension and Termination

8.1 Termination by Platform

Your account may be suspended or permanently terminated without prior notice in the following circumstances:

• Breach of this Agreement
• Suspicion of illegal activity
• Behaviour harmful to the Platform
• Prolonged account inactivity (12+ months)

8.2 Termination by User

You may delete your account at any time via the panel. The deletion process is completed within 30 days and your data is permanently deleted except for periods specified in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Platform shall not be liable for indirect, special, incidental or consequential damages (including loss of revenue, data or reputation).

The Platform's total liability for direct damages shall be limited to the subscription fees paid in the 3 months prior to the date of the damage. For free plan users, this limit is zero.

10. Intellectual Property

The CalenFox brand, logo, design, software and content belong to DijiFor Yazılım Danışmanlık Ltd. Şti. and all intellectual property rights are reserved.

By registering on the Platform, you grant us a limited, non-transferable licence to use your profile content for the purpose of displaying it on the Platform, processing it and providing the booking service. This licence terminates when you delete your account.

11. Privacy

The processing of your personal data is governed by our Privacy Policy. The Privacy Policy forms an integral part of this Agreement.

12. Changes

We may amend this Agreement with prior notice. For material changes, a notification will be sent to the email address associated with your account. Continued use of the Platform after a change takes effect constitutes acceptance of the updated terms.

13. Governing Law and Disputes

This Agreement is governed by Turkish Law. Istanbul Courts and Enforcement Offices shall have jurisdiction over disputes arising from this Agreement.

For EU-resident users, the right to apply to the competent Data Protection Authority for GDPR-related disputes is reserved.
